Specialty Court Program AccountOriginal and Amended Returns

Original Return

Repealed effective Jan.1, 2020. However, previously assessed costs must be reported and remitted when collected.

Total Amount of Specialty Court Program Fees Collected
In addition to other costs on conviction, a person shall report and pay $60 as a cost of court on conviction of an offense punishable as a Class B misdemeanor or any higher category of offense under:
  1. Chapter 49, Penal Code (Intoxication and Alcoholic Beverage Code)
  2. Chapter 481, Health and Safety Code (Texas Controlled Substance Act).
Amount Retained (50%) for Established Specialty Court Program
If the county has established a drug court program, or establishes a drug court program before the expiration of the calendar quarter, retain and report 50 percent of the funds collected under this article. These funds are to be used exclusively for the maintenance of drug court programs operated within the county. This will be in addition to the 10 percent service fee if payment was submitted on time.
Service Fee
If the custodian of the county treasury submits a timely payment, the system will calculate a 10 percent service fee to be retained by the county. This will be based on the funds collected under this article by an officer of the county during the calendar quarter.

Amended Returns

In most cases, you can file an amended tax or fee return using Webfile. An amended return changes the data previously filed. Amended returns filed through Webfile will reflect the data originally filed with the Comptroller's Office. Change only the data that you need to amend.

Amended returns resulting in a credit balance or refund cannot be submitted through Webfile.

Amended Returns resulting in a refund must be submitted on the appropriate form with the word “Amended” written across the top. You must also include a detailed document stating the grounds on which the claim is founded.
